How to Prepare for Your First Court Appearance at Campbelltown Courthouse

Going to court for the first time can be a very stressful and frightening experience, especially when dealing with criminal or traffic charges in Campbelltown, NSW.

This guide is designed to help you understand what to expect at Campbelltown Local Court and how to prepare for your first court appearance, often referred to as a “first mention.” By providing clear, expert guidance, we aim to help you feel more in control of the situation.

What to Do Immediately After Being Charged

Your immediate actions following being charged are critical. The very first step you should take is to seek urgent legal advice. As Matthew Ward, Partner and Accredited Specialist in Criminal Law at Morrisons emphasises:

“The sooner you get a lawyer involved, the better.”

This is not a time for panic, but a time for calm, informed action.

The First Steps After Being Charged

Here are the immediate steps you should take to protect your rights and your future:

  • Get legal advice – even if you are at the Police Station, you have the right to contact a lawyer. At Morrisons, we can advise as to the right to silence, forensic procedure applications and the process for release.
  • Strictly comply with all bail conditions: You will likely be subject to bail conditions. Breaching these can result in you being arrested and taken back before the court for a breach of bail.
  • Gather all your paperwork: it might sound simple, but you may receive quite a lot of paperwork before you leave the Police Station. It is important to keep track of this and provide it to your lawyer. This will include documents such as  your Court Attendance Notice, bail conditions, and any ADVOs that are in place.
  • Diarise your court date: this is an important date that you may have to attend if you don’t have a lawyer, or you are on bail. If you miss this date, your case could be finalised in your absence or a warrant could be issued for your arrest.

Understanding the Legal Process at Campbelltown Local Court

Your first court appearance, or “first mention,” will be held in the Local Court. This initial stage is for you to enter your plea. You can also seek an adjournment for legal advice if you need to.

If you were to enter a plea of guilty, your case may proceed to sentence. If you enter a plea of not guilty, your case may be adjourned for the brief of evidence to be served, or set down for hearing (depending on the type of charge).

This is an important step and will dictate what procedure your case will move through.

The Role of a Lawyer

Having an experienced Campbelltown Criminal lawyer by your side can significantly influence the outcome of your case. The specialists at Morrisons focus exclusively on criminal and traffic law, with extensive local expertise in regional courts like Campbelltown. We have three Accredited Specialists in criminal law.

We can provide representation for a variety of offences, including:

  • Criminal Law: This includes assault, domestic violence, and drug offences. Courts treat possession and supply of drugs very differently; supply is considered a more serious charge. A common misconception is that a complainant can easily withdraw domestic violence charges, but the process is far more complex.
  • Traffic Law: We handle charges like drink driving. A common misconception is that you can easily get a “work licence” in NSW, which is not the case.

Matthew Ward points out that a strong defence relies on thorough preparation and courtroom advocacy:

“Your lawyer will review the police’s evidence and advise on the best course of action.”

They can also present a powerful plea in mitigation if you choose to plead guilty, which may result in a more lenient penalty, such as a fine, a Community Correction Order, or even a Section 10 dismissal, which means no criminal conviction is recorded.

Pleading Guilty vs. Not Guilty

Your lawyer will help you understand your options and the potential consequences of your plea.

  • Pleading Not Guilty: If you dispute the charge, your lawyer will advise you to plead not guilty. The police must then prove the charge against you beyond a reasonable doubt.
  • Pleading Guilty: If you accept you committed the offence, your lawyer can present a strong plea in mitigation. This is crucial for securing the best possible outcome, as it highlights your personal circumstances and good character.

What to Do on the Day of Your Court Appearance

To help you feel more prepared, here is some practical information about attending the Campbelltown Courthouse.

Getting to Campbelltown Courthouse

The Campbelltown Courthouse is located on Railway Street.

  • By Train: The courthouse is conveniently situated just a short 2-3 minute walk from Campbelltown Railway Station. Exit the station onto Railway Street, turn right, and continue straight to reach the courthouse.
  • By Bus: Several bus routes service the Campbelltown area, with stops located near the courthouse.
  • By Car: While some limited street parking is available on Railway Street, you should plan your parking in advance, as spaces can fill up quickly on busy court days.

What to Wear to Court

Your appearance is a powerful way to show respect for the legal system and the seriousness of your situation. First impressions are formed within seconds and are difficult to change. Dress conservatively and professionally.

  • For Men: A business suit is ideal, but a button-down shirt tucked into dress pants or khakis is also acceptable. Make sure your clothes are clean, neat, and tidy.
  • For Women: A pantsuit, a conservative dress, or a skirt with a blouse are all appropriate options. Skirts and dresses should be at or below the knee.
  • General Rules: Choose neutral colours like navy blue, gray, or brown, as they convey professionalism and seriousness. Avoid clothing with logos, graphics, or loud patterns. Always wear closed-toe shoes and ensure your appearance is well-groomed, with neat hair and minimal accessories.
